Donation Method of Shanghai Cultural Development Foundation
(Tentative)
Article 1: This Method is constituted according to Donation Law for Public
Welfare of People's Republic of China, related policies, regulations and the
Charter of the SHCDF.
Article 2: Based on the Mission of " granting public culture, promoting
cultural innovation, fostering cultural talents, enhancing cultural exchanges so
as to prosper the cultural undertaking in Shanghai", we actively strive after
governmental grants, contribution from domestic and foreign organizations as
well as individuals from all walks of life.
Article 3: The contribution must abide by legal and voluntary principles.
Article 4: The SHCDF encourages active contribution from natural persons,
legal entities or other organizations at home and abroad for the prosperity of
the cultural undertaking in Shanghai.
Article 5: The contributor can donate funds, material objects or
intellectual property rights to the SHCDF. The property donated must be legal
property for which the donor is entitled to transact.
Article 6: The contribution can be carried out as the following:
(1)General donation: the donor contributes to the SHCDF without particular
conditions, and the donated property can be managed by the SHCDF according to
Fund Management Method of the SHCDF.
(2)Special Donation: when the donation reaches certain sum, the donor can
propose particular donating terms. But the terms proposed must be in accordance
with the mission of the SHCDF, the property donated is managed by the SHCDF
according to Fund Management Method of the SHCDF..
Article 7: The SHCDF receives donation under regulatory procedure and
strictly executes the policies for transferring and safeguarding donated
properties as well as the accounting practices.
Article 8: The SHCDF receives donation according to the following
procedures:
(1)As the donee, the SHCDF signs the contract of donation with the donor;
(2)The SHCDF handles the transfer of the donated property, including
(handle) the registration procedure for the transfer of legal property right;
(3)If the donation exceeds a certain upper-limit, notarization can be made
as stipulated by both parties;
(4)The SHCDF issues lawful voucher to the donor;
(5)The SHCDF awards a certificate to the donor; and
(6)The SHCDF registers for the donated property. Those anonymous
contributions are directly registered.
Article 9: The contract of donation shall include the following: the title,
amount, quality and value of the donated property; the time, place and manner of
implementation of the contract, methods for solving disputations as well as
other terms stipulated by both parties.
Article 10: The property donated by the donor to the SHCDF belongs to the
SHCDF, which properly utilizes the property according to the Charter of the
SHCDF and the contract of donation.
Article 11: When disputation occurs as far as the donation is concerned,
both parties shall solve it according to the stipulation in the contract of
donation and related legislations.
